General Terms and Conditions (GTC) of Kai Tachibana / Nordland Electronics

§1 Validity towards entrepreneurs and definition of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer * in the version valid at the time of the order.

* A consumer is any natural person who concludes a legal transaction for purposes that can largely not be attributed to their commercial or independent professional activity (§ 13 BGB). 

§2 Formation of a contract, storage of the contract text

(1) The following regulations on the conclusion of a contract apply to orders via our internet shop https://nordland-electronics.de and http://nordland-electronics.com

(3) The presentation of the goods in our online shop does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

The offer is accepted in writing or in text form or by sending the ordered goods within one week. After the fruitless expiry of the period, the offer is considered rejected.

(4) The following rules apply when an order is received in our online shop: The consumer submits a binding contract offer by successfully completing the ordering procedure provided in our online shop.

The order takes place in the following steps:

  • Selection of the desired goods.
  • Confirm by clicking on the buttons (hereinafter also referred to as buttons "Add to cart".
  • Check the information in the shopping cart.
  • Pressing the "Checkout" button.
  • Registration in the internet shop after registration and entry of the applicant details, such as name, address and possibly different delivery address, email and password. The first registration must be confirmed with a control number that will be sent to you by email. To do this, follow the instructions in the email.
  • Another check or correction of the respective data entered, as well as confirmation that you have read and accepted the data protection declaration.
  • Binding sending of the order by clicking the box: "I have read the terms and conditions and cancellation policy. I agree ”and then the button“ Order with costs.
    Before submitting the binding order, the consumer can return to the website on which the customer's details are recorded by pressing the "Back" button or the "Logout" button in the Internet browser they are using and correct input errors or cancel the ordering process by closing the Internet browser. We confirm receipt of the order immediately by an automatically generated email (confirmation of receipt). This does not constitute acceptance of the offer. The offer is accepted in writing, in text form or by sending the ordered goods within one week.

(5) Storage of the contract text for orders via our internet shop: We save the contract text and send you the order data and our terms and conditions and declaration of cancellation by email. You can also view the terms and conditions at any time at https://nordland-electronics.de/agb.html. You can view your past orders in our customer area under My account -> "View orders".

§3 prices, shipping costs, payment, due date

(1) Unless otherwise stated in the seller's product description, the prices quoted are total prices that include the statutory value added tax. If applicable, additional delivery and shipping costs are specified separately in the respective product description.

(2) For deliveries to countries outside the European Union, additional costs may arise in individual cases, which the seller is not responsible for and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs can also arise in relation to the money transfer if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

(3) The customer has various payment options available, which are specified in the seller's online shop.

(4) If prepayment has been agreed, payment is due immediately after the contract is concluded.

(5) If payment is made using a payment method offered by PayPal, payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal terms of use, available at https://www.paypal.com/de/webapps/mpp/ua / useragreement-full or - if the customer does not have a PayPal account - subject to the conditions for payments without a PayPal account, visible at https://www.paypal.com/de/webapps/mpp/ua/privacywax- full.

§4 delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for dispatch immediately. The delivery takes place latest within 6 working days. In the case of payment in advance, the delivery period begins on the day after the payment order has been sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract has been concluded. If the period ends on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer only when the item is handed over to the buyer.

(3) If the transport company sends the goods back to the seller, because delivery to the customer was not possible, the customer bears the costs of the unsuccessful shipment. This does not apply if he is not responsible for the circumstance that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller had announced the service to him a reasonable time in advance.

§5 retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

§6 liability for defects

(1) If the purchased item is defective, the provisions of the statutory liability for defects apply.

(2) The customer is asked to complain to the deliverer about goods delivered with obvious transport damage and to inform the seller thereof. If the customer does not comply, this has no effect on his legal or contractual claims for defects.

§7 Applicable law

(1) The law of the Federal Republic of Germany applies to all legal relationships of the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer is habitually resident.

(2) The statutory warranty regulations apply.

§8 Information on online dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: http://ec.europa.eu/consumers/odr
This platform serves as a point of contact for out-of-court settlement of disputes arising from online sales or service contracts in which a consumer is involved.

§9 contract language

As contract language german will be available exclusively.
